I am working on a paper for my Ph.D. program looking at the Texas v. Becerra case regarding Section 504. Today, with the help of my university law librarian, I went through the actual laws and executive orders that are mentioned in the lawsuit and news about the lawsuit. I have seen such misinformation and potential disinformation shared by republican attorney generals and the news that I want to clear up.
1. Biden used an executive order to extend the definition of disability to include people with disabilities.
FALSE: The executive order that is being referred to is EO 13988 passed Jan 20, 2021. This EO extends protections against discrimination on the basis of sex and sexual orientation under Title VII of the 1964 Civil Rights Act. The only mention of disability in this executive order is to refer to how someone's trans identity may intersect with other identities protected under anti-discrimination laws such as disability and race. "For example: transgender Black Americans face unconscionably high levels of workplace discrimination, homelessness, and violence, including fatal violence."

2. The 'Final Rule' of Section 504 effective July 8, 2024 extends the definition of disability to include gender dysphoria.
MIS/DISINFORMATION: The preamble of the rule (which is not the law itself, but helps interpret the law) does discuss how gender dysphoria might be protected under Section 504. The preamble addresses PUBLIC discussion points. There is no mention of gender dysphoria in the actual ruling as written. The link to preamble is below. You can find a draft of the law as written towards the end on page 114 (pdf) or page 40179 of the actual document.

3. The lawsuit ONLY attacks the inclusion of gender dysphoria.
FALSE: There are several counts that the lawsuit makes. The Final Rule is adding updated protections for people with disabilities given the last 20 years (especially the last 5). One of the added protections is to say that a person cannot be denied medical treatment solely based on the belief that disabled lives are inherently less valuable than non-disabled lives. Ex. you cannot deny a person with Autism a heart transplant on the basis of their Autism. Counts 2 and 3 in the lawsuit address the Final Rule and Section 504 at large respectively and claims that they are both a coercive use of federal powers. In the demands, the plaintiffs (the states suing) are demanding that Section 504 in total be deemed unconstitutional and the states be free from having to enforce 504.

Law can be really confusing to understand. However, it is very important that we remember the facts and stand aligned with trans people. The radical right has been building transphobic sentiments and are currently using them to try to confuse and disguise their actions. Section 504 required the collective action of people with a variety of disabilities and our allies (including the Black Panther Party! Watch CripCamp on Netflix!). We must stand aligned in our goals. Trans people deserve protection. Disabled folks deserve protection. But we will not win this fight divided.

Happy first day of Spring 2025! This year I am practicing sustainable work. The world is terrifying and confusing. There is so much demand of ourselves. This year is about radical rest and community. It’s about protecting myself from burnout and make sure I don’t lose sight of the community I am doing this for. How are you guys practicing radical rest this semester?

So the sad news is no video this week. The good news is that the reason there is no video is that I went on my (hopefully) final apartment tour and put in an application for an apartment! It’s finally feeling real that Sophie and I will be starting our new journey coming August!! ❤️

Hello everyone! I just want to take a quick second to welcome and thank all the new people joining my channel recently! It has been incredible to start to see this little community grow this last month.

With that said, I won’t be posting a video this week. I got a little behind on recording and loaned out my camera for the week. But I am still prepping new content. Right now I’m working on a true Disability 101 series for newly disabled folk and people who want to know more about disability but don’t know where to start. What you all like me to talk about?
