A few weeks ago, we had made a video about the challenges of J1 and F1 visa holders in the United States. As of today, December 9, 2024 - The U.S. Department of State has announced a major update to the Exchange Visitor Skills List. This is the first significant revision in 15 years and removes the two-year home-residency requirement for J-1 visa holders from 34 countries, including China, India, South Korea, Saudi Arabia, and the UAE. These changes have profound implications for individuals, employers, and U.S. innovation.
The two-year home-residency requirement applies to certain J exchange visitors, who must live in their home country after their exchange program ends. This requirement applies to change of status to H or L status, becoming a lawful permanent resident, or receiving an H, L, K, or immigrant visa. However, there are some exceptions, such as the Conrad State 30 Program, which allows waivers for foreign physicians who provide medical services in underserved areas.
